So let me get this straight, this person wanted you to do something with some gems, but then when you gave them back to him he wouldn't pay you?

How was he able to take the money out before clicking trade, without the system forcing you to click the trade button? From what I understand, as soon as he took that money out, he should have had to wait for you to click trade again. So, presumably, he should never have been able to trick you at all...

I believe they are, which I think last time I was told anything if caught going on a private server they might ban you, but that's the same with letting ANYONE else play your account or making any kind of deals like buying gold or powerlevelling, but with the emulated servers they have nowadays, there's no real connection to the real server, so Blizzard doesn't really have much to go off of.

 

And last I checked, not ALL private servers are illegal, Blizzard sells the software to make the server for a couple Grand, I think, which is where the pay private servers come into effect.
